Bekend merk liet mijn site verwijderen en hoe jij dit voorkomt

Wanneer ik na mijn ochtendritueel aan de slag wil met een pagina op mijn website kan ik er niet bij. Mijn site geeft een grappig plaatje en een foutmelding.

Korte conclusie: Wil je geen gedoe, koop dan geen domeinnaam waarin je een bekend merk verwerkt.

Wat achtergrond hoe het zo ver kwam dat Facebook mijn site offline liet halen.

Eind 2009 zag ik dat Facebook steeds interessanter werd voor bedrijven. Amerikaanse bedrijven, winkels en organisaties opende een Facebook pagina en verzamelde Like. In Nederland gebeurde dit op dat moment nog heel weinig.

Daar zag ik een kans. In 2010 schreef ik heel veel artikelen over Facebook. Hoe je een pagina opzet voor je bedrijf. Hoe je de pagina verbeterd. Hoe je meer Likes en meer interactie krijgt op de pagina. En nog veel meer.

Er was ruimte voor een training en een e-boek over dit onderwerp. In 2010 de eerste versie en ieder jaar werd het completer en beter. Ondertussen had ik ook 2 domeinnamen gekocht om het e-boek en de training eenvoudiger te kunnen aanprijzen. dutchfacebookguy.com en facebookvoorcoaches.nl

Ik gebruikte de Dutch Facebook Guy en later de Dutch Facebook Biz Guy in mijn profielen online en ook op mijn pagina’s.

Een eerste melding van het gebruik van Facebook in de domeinnaam kreeg ik 31 januari 2014 voor dutchfacebookguy.com. Deze had ik wat genegeerd. Later, 3 april 2014, kwam er een nieuwe melding.

We write regarding your registration and use of the domain name dutchfacebookguy.com, which contains the famous Facebook trademark.

Het contract voor dit domeinnaam liep bijna af. Ik heb het contract geannuleerd. Daarna heb ik verder niet meer van gehoord.

In mijn onnozelheid heb ik de domeinnaam facebookvoorcoaches.nl bewust vergeten of genegeerd.

Tot ik ik 21 mei 2015 een nieuwe melding van het legal team van Facebook kreeg. Nu ging het over facebookvoorcoaches.nl, de titel van de training en het e-boek.

We are writing concerning your registration and use of the domain name facebookvoorcoaches.nl, which contains the famous Facebook trademark.

As you undoubtedly know, Facebook is the leading online social network service. Facebook adopted the name and trademark Facebook in February 2004 and, since that time, Facebook has actively used the Facebook name and trademark in connection with its online social network service, including maintaining the web site www.Facebook.com. The term Facebook is one of the most famous trademarks on the Internet. Facebook owns exclusive trademark rights to the Facebook name as a result of numerous trademark registrations in the United States and internationally, as well as related common law rights. Accordingly, Facebook enjoys broad trademark rights in its name.

Facebook has made a substantial investment in developing and providing its services. As a result of Facebook’s pioneering efforts and devoting substantial effort and resources to providing only high quality services, the Facebook name and trademarks are widely known among the consuming public worldwide, and the name and trademarks embody substantial and valuable goodwill.

Accordingly, we were concerned when we learned of your registration and use of facebookvoorcoaches.nl. As we hope you can appreciate, protection of its trademarks is very important to Facebook. Your registration and use of facebookvoorcoaches.nl violates the Lanham Act (15 U.S.C. 1051 et seq.) because it infringes and dilutes the famous Facebook trademark.

Infringement occurs when a third party’s use of a company’s trademark (or a confusingly similar variation thereof) is likely to confuse consumers as to the affiliation, sponsorship or endorsement of the third party’s services. Trademark dilution occurs when a third party’s use of a variation of a company’s trademark is likely to lessen the distinctiveness of the company’s famous trademark.

We have filed several proceedings before the United Nation’s World Intellectual Property Organization’s arbitration panel. Facebook has prevailed in each case and the domain names at issue were all ordered to be transferred to Facebook. Facebook is concerned that your unauthorized use of the Facebook name may cause confusion as to whether you or your company’s activities are authorized, endorsed or sponsored by Facebook when, in fact, they are not.

We understand that you may have registered facebookvoorcoaches.nl without full knowledge of the law in this area. However, Facebook is concerned about your use of the Facebook trademark in your domain name. As you may know, the Anticybersquatting Consumer Protection Act provides for serious penalties (up to $100,000 per domain name) against persons who, without authorization, use, sell, or offer for sale a domain name that infringes another’s trademark.

While Facebook respects your right of expression and your desire to conduct business on the Internet, Facebook must enforce its own rights in order to protect its valuable and famous trademark. For these reasons, and to avoid consumer confusion, Facebook must insist that you immediately stop using facebookvoorcoaches.nl and disable any site available at that address. You should not sell, offer to sell, or transfer the domain name to a third party and should let the domain registration expire.

Please confirm in writing that you will agree to resolve this matter as requested. If we do not receive confirmation from you that you will comply with our request, we will have no choice but to pursue all available remedies against you.

Natuurlijk twijfel ik bij zo’n email of het wel echt is. Ik controleer nog eens het e-mailadres en het ziet er naar uit dat het echt van Facebook komt.

Later, op 2 juni 2015, krijg ik een tweede melding van Facebook.

OK, één van de domme dingen die je kunt doen is dus een bekende merknaam in je domeinnaam gebruiken. Een bekend merk met diepe zakken om hier een rechtszaak van te maken als het nodig is. Iets waar ik al helemaal geen zin in heb.

Nog dommer is het om dit voor je uit te schuiven als je een dwingend verzoek krijgt om dit te veranderen.

Het stond vorige week al in mijn agenda om te doen, maar ik was er niet aan toegekomen. Dinsdag stond het opnieuw in mijn agenda, nu als prioriteit nummer 3 op mijn lijstje.

Het was al te laat.
Al snel werd het priorieit No.1 om op te lossen.

Een eerste verzoek van mijn hosting bedrijf kreeg ik 2015.07.08 01:45 PM (PST)

De laatste melding was dat mijn site offline is, sinds maandagavond 23.16u:

“On 7/8/2015 we notified you about the trademark infringement complaint we received in reference to your (mt) Media Temple hosted website, facebookvoorcoaches.nl (the “Subject Site”). In that notice, we asked that you please remove all references to the Facebook Mark on the Subject Site and elsewhere on our systems. You were cautioned that if you failed to act (within 24 hours of our notice) to remove all references to the Facebook Mark on the Subject Site and our systems, we would be forced to entirely suspend access to the Subject Site until such time as you have confirmed, and we have verified your full compliance with the request.

At this writing, it appears that you have not acted to remove the Facebook Mark from the Subject Site and our systems. Accordingly, we have been forced to suspend access to the Subject Site and you are NOT PERMITTED to re-enable or otherwise restore access to the Subject Site until such time as all of the following conditions have been satisfied to our satisfaction:

Dan valt je dagplanning in duigen. Zeker als je in de ochtend een e-mail hebt gestuurd met een link naar een nieuw artikel. Er klikken normaal een paar honderd mensen op een link naar mijn website in zo’n e-mail van mij. Vandaag komen ze niet verder dan een foutmelding.

Eén van de redenen dat ik heb gekozen voor MediaTemple is hun bereikbaarheid. Dus ik heb contact met ze gezocht via de chat. De conclusie van dit gesprek:

“As this issue is being handled by our Legal Department, here in support we are unable to take any action on this account until advised by them that the issues at hand were resolved.”

“They are here during normal business hours of 8am-5pm PST.”

Dat betekent dat ik niet eerder dan tegen het einde van de dag wordt gekeken naar mijn actie om de domeinnaam te annuleren. Aan de website kan ik nu niet veel veranderen. Ik kan er niet bij.

Overal de merknaam verwijderen

Ik lees het bericht van MediaTemple nog eens na. In het bijzonder dit deel. Ik lees het wel drie keer.

“1. Completely remove all instances of the Facebook Mark from the Subject Site and our systems (particularly, but not limited to, at facebookvoorcoaches.nl and https://decideforimpact.com/facebook-voor-coaches/); and
2. Cease all use of the Facebook Mark on the Subject Site and our systems;“

Dit lijkt er op dat ik alle “Facebook” vermeldingen moet verwijderen van mijn site. Het ging in eerste instantie alleen over de domeinnaam. De domeinnaam die geregistreerd is bij TransIP en doorverwijst naar één pagina op mijn website.

Aangezien mij dit verward, heb ik een paar vragen gesteld aan Charlotte Meindersma van Charlotte’s Law. Voor mij één van dé experts op dit gebied. “Je zou het woord Facebook moeten vervangen ja. Ben van mening dat het niet hoeft.”

Oh nee, dat is wel heel veel. Want er staan heel wat artikelen op mijn site met honderden reacties. Zou toch zonde zijn wanneer deze moeten worden verwijderd.

Het is een lastig onderwerp, dat werd steeds duidelijker. Joost de Valk van Yoast.com zegt op Facebook, in een reactie op mijn bericht, dat hij ook zeer alert is op het gebruik van de merknaam Yoast. Zijn bedrijf laat ook de website offline halen als er niet wordt gereageerd. Ook in Nederland gebeurt dit.

Joost “wij laten met regelmaat sites met yoast in de domeinnaam of anderszins misbruik van ons trademark down halen…”
Erno “Lukt dat in NL net zo snel als in de VS Joost?”
Joost “Ligt er aan bij welke host. Maar trademarks zijn in Europa ook goed beschermd en als het lijkt of jij iemand impersonate, dan wel ja. Een trademark in je domeinnaam gebruiken is daarom eigenlijk nooit handig.”

Na verder zoeken heb ik ook allerlei uitleg gevonden op de site van Facebook over het gebruik van het merk, de merknaam, logo’s en meer. Je leest er hier meer over https://www.facebookbrand.com.

Om te voorkomen dat ik alle artikelen over Facebook moet verwijderen heb ik een e-mail gestuurd. Ik heb Facebook gevraagd of annulering van de domein facebookvoorcoaches.nl voldoende is. Iets dat ik dinsdagochtend in een soort paniek direct gedaan.

“Today I have cancelled the domain name facebookvoorcoaches.nl. The domain name is now in “quarantaine” at SIDN.
It was on my todo list to take care of this but apparently you felt I was not fast enough.

This domain name was redirected to a page on my website at decideforimpact.com/facebook-voor-coaches/

Now my complete website decideforimpact.com is offline upon your request at MediaTemple. Hopefully by the end of today this is all resolved.

Can you please confirm that canceling the domain name ‘facebookvoorcoaches.nl’ is sufficient to solve this matter?

The message at sidn.nl
“The domain name’s registration has been cancelled. Following cancellation, a .nl domain name is placed in quarantine for forty days.”

Op deze vraag heb ik nog steeds geen reactie ontvangen.

Dinsdag om 17.30u kreeg ik het volgende bericht van MediaTemple:

“As a one-time courtesy, we have re-enabled the Subject Site. You will have until 4:00 p.m., PST to remove the Facebook Marks from the Subject Site.

Please keep in mind if you are unable to remove the Facebook Marks from the Subject Site during the brief window we provide to you, we will be forced to again disable the Subject Site, and you will need to contact a server administrator to assist you with removing the content via your server.

Lastly, should you have any questions, please update this support request in the Media Temple AccountCenter and someone from our Legal Team will get back to you as soon as possible. Thank you in advance for your cooperation.”

Gelukkig kon ik nu aan de slag. Bedenken wat in ieder geval handig is om te verwijderen of aan te passen.

De aanpassingen

Wat heb ik gedaan:

  • Domeinnaam met de merknaam per direct geannuleerd
  • Waar ik het kon vinden heb ik de opmerking “The Dutch Facebook Biz Guy” verwijderd. – Joost de Valk (Yoast.com) zei dat dit lastig zou kunnen zijn. Het lijkt hiermee alsof je je voordoet als iemand van Facebook.
  • Verkeerde Facebook logo’s verwijderd van de verkooppagina’s rondom de training en het e-boek
  • Facebook in de URL naar diezelfde verkooppagina’s aangepast naar fbook – fb heeft Facebook namelijk ook geregistreerd
  • Een opmerking toegevoegd aan de verkooppagina en belangrijkste pagina over Facebook dat ik geen relatie heb met Facebook. Zie hieronder voor de exacte woorden.

Dinsdagavond rond 20.30u ben ik één van de sprekers in een webinar van Cindy Vranken. In dat webinar geef ik een tip en een cadeautje via mijn website. Als mijn website offline is tegen die tijd… niet handig.

Gelukkig is mijn website tijdens het webinar nog steeds online.

Voordat het webinar begint stuur ik een korte update naar MediaTemple, mijn hostingleverancier:

“I am still working on it.

Just to inform you I have cancelled the domain facebookvoorcoaches.nl, the initial request from Facebook.

I am in the process of renaming the pages where I offer services in relation to Facebook.

I am adding the following statement to these pages
“Opmerking: decideforimpact.com is geen officiële dealer van Facebook of geaffilieerd met Facebook. Facebook is een geregistreerd merk. Facebook is a Registered Trademark and decideforimpact.com has no direct or indirect affiliation with Facebook. decideforimpact.com has no partnership, sponsorship or endorsement from Facebook.”

Na het webinar heb ik de website verder aangepast. Daarna heb ik de melding van MediaTeample aangevuld en als opgelost gemarkeerd.

“I have either removed pages or changed the facebook mention in a url to fbook for my pages.

For my posts/articles on Facebook I did not change anything. Hopefully that is OK. I can’t see this being a problem with so many posts on Facebook in blogs on the web.

My day has ended on this side. I will be back at 5 am (CET) hopefully my website is still online.”

Nu maar hopen dat het voldoende is.

Vol spanning ging ik de volgende ochtend als eerste naar mijn site. Opluchting. Gelukkig de website werkt nog steeds.
Geen bericht van MediaTemple. Geen reactie van Facebook op mijn vraag. Maar mijn website staat nog steeds live.

Mag je dan ook bloggen over een merk, er werkboeken voor schrijven en cursussen voor aanbieden? Ja, in principe mag je daar gewoon over schrijven, maar kijk wel uit! Je mag niet lijken of jij een commerciële band hebt met dat merk. Het moet duidelijk zijn dat jij uit eigen initiatief schrijft. Als het net lijkt of jij een officieel communicatiekanaal bent van het merk of met hen samenwerkt of voor het merk werkt, maak je mogelijk onrechtmatig gebruik van het merk. Je trekt ongerechtvaardigd voordeel uit het benoemen van het merk of doet afbreuk aan het onderscheidend vermogen of de reputatie van het merk.”

Hoe voorkom jij dit

Ik weet dat ik dit niet slim heb gedaan. Ik ben dan ook vooral boos op mijzelf dat ik het niet eerder heb opgepakt.
Jij bent vast niet zo dom en laat dit niet gebeuren. Zeker nu niet meer. Toch?

Dan kan je niet gebeuren wat mijn dinsdag gebeurde….
Een melding van je hostingbedrijf dat je site offline is gehaald.

Misschien vraag je je af waarom ik dit soort stommiteiten van mijzelf deel. De onachtzaamheid hoe ik met dit soort dingen om ga.

Dat heeft maar één reden. Het is mij gebeurt. Ik ben behoorlijk geschrokken en heb er van geleerd. Dus ik deel dit zodat jij dit soort dingen kunt voorkomen.

Wat heb ik geleerd:

  1. Geen merknaam verwerken in je domeinnaam.
  2. Altijd bij de producten die je verkoopt rondom een bekend merk, melden dat je geen officiële dealer bent of geaffilieerd.
  3. Altijd direct een reactie sturen als er e-mails komen van zo’n merk.

  1. Als ik één nuance mag aangeven: Ik vond vooral dat ze vroegen overal het woord Facebook te verwijderen. Niet dat jij dat per sé moest doen. Zoals je zelf al aangeeft: Facebook heeft deep pockets en schromen niet om naar de rechter te stappen. Dat is vooral een reden om toch maar mee te werken en om soms zelfs iets beter mee te werken dan strikt noodzakelijk is. Jammer dat ze niet meer gereageerd hebben, maar prettig dat je site nog steeds online is.

    Overigens is de mail van Facebook wel een erg standaard mail. In Nederland zoek je meestal nog op wie het geregistreerd heeft en probeer je de brief wel aan een persoon te richten. Ik kan goed begrijpen dat je daarom denkt dat het nep was. Ze verwijzen ook steeds naar Amerikaanse regelgeving, terwijl die niet per sé van toepassing is. (De inbreuk vindt (voornamelijk) plaats in Nederland).

    Wel bijzonder trouwens: veel mensen schrikken juist enorm van een mail of brief als jij nu gekregen hebt en nemen zo snel mogelijk actie.

    Als je een merk hebt is handhaven ook wel erg belangrijk. De juridische waarde van een merk kan anders bijzonder snel dalen en dat wil je echt voorkomen. Als je het ene moment niet ingrijpt kan het lastig worden in een andere situatie wel in te grijpen. En je moet vooral ook voorkomen dat het merk een gewoon woord wordt.     Dank je wel voor het delen! Wat ik dan weer een grap vind is dat de reclame uiting van Philips in het plaatje wordt gebruikt. Gaat Philips daar op haar beurt actie op ondernemen?
